DMCA Policy
How we handle copyright infringement claims and protect intellectual property on our platform.
Filmit.io respects the intellectual property rights of others and expects our users to do the same. This policy outlines our procedures for responding to claims of copyright infringement in accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. § 512.

All DMCA notices and counter-notifications can be submitted using the form below or sent to the email address above. We aim to respond to all valid notices within 2 business days.
Filing a Takedown Notice
If you believe that content posted on filmit.io (including forum posts, blog posts, user profiles, or uploaded assets) infringes your copyright, you may submit a DMCA takedown notice using the form below. Your notice must include:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work you claim has been infringed. If multiple works are involved, provide a representative list.
- Identification of the infringing material and its location on our site (provide specific URLs).
- Your contact information: name, mailing address, telephone number, and email address.
- A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner.

Our Takedown Process
When we receive a valid DMCA takedown notice, we will:
- Acknowledge receipt of the notice within 2 business days.
- Review the notice for completeness and compliance with DMCA requirements.
- Promptly remove or disable access to the allegedly infringing material.
- Notify the user who posted the content that it has been removed, including a copy of the takedown notice.
- Provide the user with information about filing a counter-notification if they believe the takedown was made in error.
We take all valid takedown notices seriously and act in good faith to protect the rights of copyright holders.
Counter-Notification
If you believe your content was wrongly removed due to a DMCA takedown notice, you may file a counter-notification. Your counter-notification must include:
- Your physical or electronic signature.
- Identification of the material that was removed and the location where it appeared before removal (provide the original URL).
- A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification.
- Your name, address, and telephone number.
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the United States, the District of South Carolina), and that you will accept service of process from the person who filed the original takedown notice.

After We Receive a Counter-Notification
Upon receiving a valid counter-notification, we will:
- Forward the counter-notification to the original complainant.
- Inform the complainant that the removed content will be restored in 10 business days unless they file a court action.
- Restore the removed content after 10–14 business days, unless we receive notice that the complainant has filed a court action seeking to restrain the user from engaging in the infringing activity.
Repeat Infringer Policy
In accordance with the DMCA, Filmit.io maintains a policy of terminating the accounts of repeat copyright infringers in appropriate circumstances.
- First offense: We remove the infringing content and issue a warning to the user.
- Second offense: We remove the content and issue a final warning. The user's ability to post content may be temporarily restricted.
- Third offense: We terminate the user's account permanently.
We consider each case individually and may adjust this policy based on the severity of the infringement. Egregious or willful infringement may result in immediate account termination.
Good Faith & Misrepresentation
Filing a DMCA takedown notice or counter-notification is a serious legal action. Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be liable for damages including costs and attorneys' fees.
Before filing a takedown notice, please consider whether the use of the material falls under fair use or another legal exception. If you are unsure, we recommend consulting an attorney.
